Terms of service

These are the terms between you and Appostafat GmbH (Rothusstrasse 23, 6331 Hünenberg, Switzerland) for Fitonomy Mobility. By creating an account you accept them. If you do not, do not use the app.

What the app does

Fitonomy Mobility measures your range of motion through a ten-position test, then builds a daily mobility session from the result and rewrites it as you report how each movement felt.

It is a fitness product, not a medical one. It does not diagnose, treat or monitor any condition, and the numbers it produces are estimates from a phone, not clinical measurements. Read the Medical disclaimer — it is part of these terms.

Your account

You need to be at least 16 to have an account and at least 18, or have your parent's or guardian's permission, to buy a subscription. Keep your sign-in details to yourself; you are responsible for what happens under your account. One account per person.

Subscription, trial and billing

Fitonomy Mobility offers a 14-day free trial, then a choice of a weekly or a yearly plan.

The exact price of each is shown in the app, in your own currency, before you buy anything — it is read from the store at the moment you look at it, so it is always the price you will actually be charged. Prices differ between countries.

The trial and the subscription are sold and billed by Apple or Google, not by us. That means:

• Your subscription renews automatically at the end of each period unless you cancel.
• The trial converts into a paid subscription unless you cancel at least 24 hours before it ends.
• Payment is taken by the store account you bought it with. We never see your card details.
• You cancel through the store, not through us — App Store subscription settings on iOS, Google Play subscriptions on Android. Deleting the app does not cancel anything.
• Cancelling stops the next renewal. You keep access until the end of the period you have already paid for.

Prices are shown in your local currency in the app before you buy, and may differ between countries and over time. If we change the price of a plan you are on, the store will tell you and ask you to agree before it takes effect.

Refunds

Refunds are handled by Apple or Google under their own policies, because they took the payment. We cannot issue one. You are also entitled to any refund your local consumer law gives you.

What you keep when a subscription ends

Your account, your measurements and your history remain yours and remain readable. Daily sessions stop until you subscribe again. We do not delete anything because you stopped paying.

What you may and may not do

The exercise videos, the test, the scoring and everything else in the app belong to us or our licensors. You get a personal, non-transferable, non-exclusive licence to use them inside the app while your account is active.

You may not copy, download, redistribute, resell or publish the video library or any other content; reverse-engineer the app; use it to build a competing product; attempt to reach content you have not paid for; or use automated means to scrape it.

Availability

We try to keep the app working and will not promise it always will. We may change, suspend or discontinue features. If we discontinue the whole service we will give you reasonable notice and refund any period you have paid for and cannot use.

No warranty

The app is provided as it is. To the extent the law allows, we make no warranty that it will be uninterrupted, error-free, or that any measurement or recommendation is accurate or suitable for you.

Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to what you paid us in the 12 months before the claim. Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited — and your statutory consumer rights are unaffected.

Ending it

You can delete your account at any time from Profile → Delete account. We may suspend or close an account that breaks these terms, and will tell you why unless the law stops us.

Changes

If we change these terms we will change the version and date at the top and tell you in the app before the change takes effect. Continuing to use the app afterwards means you accept the new version.

Law

These terms are governed by Swiss law, excluding its conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods. Disputes arising from them are for the competent courts of Switzerland. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.
